Eligibility for German Citizens
German citizens are generally entitled to housing benefit, provided they meet further requirements such as income and housing situation. The application is made at the responsible housing benefit office at their place of residence.
Eligibility for EU Citizens
Citizens from EU member states can also apply for housing benefit if they are legally residing in Germany. A requirement is that they are either employed, undergoing vocational training (Ausbildung), or have sufficient financial means to secure their livelihood.
Eligibility for Third-Country Nationals
Nationals from non-EU countries (third-country nationals) can receive housing benefit if they have a lawful and permanent residence status in Germany. This includes individuals with a settlement permit, a residence permit for employment purposes, or a residence permit for the purpose of vocational training (Ausbildung).
Exclusion from Housing Benefit
Persons who are only temporarily in Germany, such as tourists or individuals with a short-term residence permit, are excluded from housing benefit. Additionally, trainees with a residence permit under § 16 of the Residence Act (study or language course) are generally not entitled to benefits.
Proof of Nationality
When applying, nationality must be proven with appropriate documents such as an identity card, passport, or residence permit. EU citizens also need a registration certificate confirming their lawful residence.
Special Regulations for Refugees
Recognized refugees in Germany with a residence permit for humanitarian reasons can also apply for housing benefit. A requirement is that they have already rented their own apartment and meet the general eligibility criteria.

Regardless of nationality, the assessment of housing benefit eligibility is conducted according to uniform criteria that apply to all applicants. Key factors include income, household size, and the amount of rent costs.
