After the probationary period, trainees (Auszubildenden) in Germany can only terminate their training relationship under specific conditions. Extraordinary Termination by the Trainee
Extraordinary termination after the probationary period is possible only if serious reasons make continuing the training (Ausbildung) unreasonable. This includes significant violations by the trainer against labor law, such as persistent discrimination, abuse, or refusal of appropriate training. In this case, the termination must be communicated immediately after the occurrence of the important reason and must be in writing.
Termination for Professional Reorientation
The trainee may also terminate the training (Ausbildung) relationship if they give up the vocational training or wish to pursue a different career path. Here, a statutory notice period of four weeks applies, allowing the training company to respond to the change. However, this termination option is only available to the trainee if they can provide evidence that they are terminating their training (Ausbildung) to engage in another professional direction.
Formal Requirements for Termination
In the case of termination after the probationary period, written form is always required. The trainee must personally sign the termination letter and detail the reasons for termination. An oral termination is invalid and is typically not recognized by the training company. Additionally, it is advisable to request confirmation of receipt of the termination letter from the training company to ensure legal clarity.
Legal Consequences and Claims after Termination
By timely or extraordinary termination, the trainee generally has no further obligations towards the training (Ausbildung) company. Compensation claims up to the termination date remain in place. However, in the case of unlawful termination, the company may incur liability for damages if it suffers particular disadvantages due to the termination.
