Basic Requirement for Funding
Citizens of the EU and EEA are generally entitled to Bafög if they have their permanent residence in Germany and meet other general requirements such as age limits, educational prerequisites, and income thresholds. It is crucial that they are gainfully employed in Germany or have acquired a permanent residency right.
Funding for EU/EEA Citizens with Employment
EU and EEA citizens who work in Germany can apply for Bafög if their employment is significantly related to their vocational training (Ausbildung). This includes, among others:
- Individuals who work in Germany while simultaneously completing vocational training (Ausbildung).
- Family members of EU/EEA citizens who work in Germany if they share their residence with the employed family member in Germany.
Proof of employment is provided by submitting an employment contract or payslips.
Permanence Residency Right
EU and EEA citizens can also receive funding if they have acquired a permanent residency right in Germany. This usually requires that the applicant has lived in Germany for at least five years and has their main residence here. The permanent residency right is regulated by the Residence Act and can be proven with a corresponding certificate.
Equal Treatment with German Citizens
In certain cases, EU/EEA citizens are treated equally to German citizens, which gives them unrestricted access to Bafög. This is the case when the applicant permanently lives in Germany and their main residence is here. Family members of German citizens can also be funded under certain conditions if they live in Germany together with the German family member.
Documentation for the Application
The following documents are required for EU/EEA citizens to apply for Bafög:
- Proof of nationality (identity card or passport of an EU/EEA state).
- Proof of residence in Germany (registration certificate).
- If applicable, proof of employment in Germany (employment contract, payslips).
- In case of a permanent residency right: proof of the duration of residence in Germany (e.g., through previous registration certificates).
Special Regulations for Family Members
Family members of EU/EEA citizens working in Germany can also apply for Bafög if they live together with the employed family member in Germany. This includes spouses and children who are undergoing vocational training (Ausbildung). Funding is provided regardless of the nationality of the family members, as long as the main applicant meets the requirements for gainful employment and residence.
