Regular Monthly Payment
According to the legal provisions in the Vocational Education Act (Berufsbildungsgesetz, BBiG), the training company is obligated to disburse the Vocational Training Compensation (Ausbildungsvergütung) on a regular monthly basis. The payment must be made by the last working day of the month at the latest to ensure that the trainee has sufficient financial resources for their living expenses.
Agreement in the Training Contract
The exact payment date is specified in the training contract (Ausbildungsvertrag). Typically, the payment occurs either:
- At the end of the month: In this case, the trainee receives their compensation for the current month.
- At the beginning of the following month: Here, the compensation for the previous month is paid retroactively.
These arrangements provide training companies with flexibility as long as the legally prescribed deadline is met.
Payment During Vocational School Attendance
The entitlement to monthly compensation (Ausbildungsvergütung) remains even during the attendance of vocational school. Since dual vocational training includes both practical and theoretical phases, the compensation must not be reduced if the trainee is attending vocational school on certain days or in block phases.
Payment in Case of Illness
If the trainee is unable to attend due to illness, there is a right to continued payment of compensation (Ausbildungsvergütung) for up to six weeks. The condition is that the illness is reported to the training company immediately and a medical certificate is provided.
Special Regulations on Holidays
If the last working day of the month falls on a public holiday or weekend, the payment is usually made on the last bank working day before the holiday. This ensures that the trainee receives their compensation on time.
Delays in Monthly Payment
In cases of delays or non-payment of the monthly compensation (Ausbildungsvergütung), the trainee should first seek a discussion with the training company. If the problem persists, the responsible chamber (e.g., IHK, HWK) can be involved. In severe cases, legal employment actions can be initiated to claim the outstanding compensation.
